Teachbits, InfoSource, and its partners and affiliates provide their services to you under the following conditions. By continuing on and by using any of the services here, you accept these conditions.

This Agreement is effective on your date of acceptance and continued in perpetuity unless we cancel. You may cancel at any time by ceasing to visit our sites.

COMMUNICATIONS
When you visit Teachbits.com or respond to us via email or on one of our forms, you are communicating with us electronically and, thereby, consent to receive communications from us electronically in return. You agree that any notices, emails, forms, or other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

COPYRIGHT
All content on this site, such as graphics, logos, text, icons, images, audio and video clips, text files, data collections, software, and related information, is the property of InfoSource, Inc. or its content suppliers. As such, all this content is protected by international and United States copyright laws.

USING TEACHBITS.COM
While using Teachbits.com or any other Teachbit- or InfoSource-related (owned) sites, you agree that you will not do any of the following:

  • Post information that is false, misleading, defamatory, obscene, or libelous
  • Use the site if you are unable to enter into a legally-binding contract or if you are under the age of 18
  • Use any means to undermine the feedback or rating systems that we have in place
  • Violate any laws, third-party rights, or our policies as stated elsewhere on this site
  • Transfer your account to another person or entity without our express written permission
  • Fail to deliver payment for any item purchased on this site
  • Devise means to alter our systems, payment and fee structure, or interfere with the procedures we've developed for an orderly marketplace
  • Change the price or in any way modify another user's listings and information
  • Post spam or anything associated with pyramid schemes, chain letters, or mass marketing
  • Upload, convey, or otherwise distribute viruses, worms, or other technologies that are designed to harm Teachbits or the other participants of the Teachbits or InfoSource sites or related sites
  • Collect information about Teachbits users, including email addresses, without their express written consent

SITE MISUSE
Without limiting our remedies, we have the right to remove individuals, organizations, groups, or others who we feel are damaging or attempting to damage our sites. Consequently, we may suspend or terminate our service and user accounts, and prohibit site access, at any time, without notice, and for any reason. We also have the right to cancel unconfirmed accounts.

CONTENT LICENSE
Should you provide us content for sale or distribution, you must also agree to our Author Agreement separately. However, under any case, you grant us a non-exclusive, worldwide, perpetual, and irrevocable right to market that content in any media known now or in the future as long as you choose to keep that content active at Teachbits. (We must have these rights in order to host and promote your content.)

LICENSE AND SITE ACCESS
Teachbits.com and InfoSource, Inc. grant you limited license to access and make personal use of our sites and not to transfer, move, or download any portion of our sites, except for those items specifically designated for sale. This site, and any other sites owned or operated by Teachbits.com or InfoSource, Inc., or any portion of them, may not be duplicated, reproduced, copied, modified, sold, or in any other way used for commercial purposes unless you have the express written consent of InfoSource, Inc. You may, however, provide links to our sites, so long as you do not portray Teachbits.com or InfoSource, Inc. or any of our products or services in a misleading, derogatory, or unsavory fashion. You may not use our logos, trade names, or marks without our express written consent.

PRODUCT DESCRIPTIONS, PRODUCT CONTENT, AND PRICING
Teachbits and its employees and affiliates use their best efforts to ensure that all product descriptions are accurate. However, because Teachbits.com is a marketplace open to all who want to post their materials, all products and their descriptions are supplied by their authors, and we do not warrant their use for any intended specific purpose, and your sole remedy is a refund of your purchase price. Teachbits.com and InfoSource, Inc. do not warrant that product descriptions and product contents are accurate, reliable, error-free, current, reliable, or suited to a specific purpose. The individual content providers (authors) are free to set their own prices for the materials they provide, and we do not warrant, nor do we attempt to verify, that these prices are the same as may be found elsewhere.

USER ACCOUNTS
You are solely responsible for maintaining your own information, password, and account information. We will use our best efforts to safeguard your information, but can accept no responsibility in the event that it is lost or stolen. We reserve the right to refuse access to our sites and our services, edit or remove content, and terminate accounts at any time, and for any reason, at our sole discretion.

USER-PROVIDED INFORMATION
Visitors to our sites may provide comments, reviews, and other information related to the materials for sale or to the sites themselves, so long as that information is not illegal, immoral, obscene, defamatory, or in violation of any laws. You may not impersonate another person or use a false email or physical address, or mislead us in any way. Should you post material, as long as you choose to keep it active at Teachbits, you grant Teachbits and InfoSource, Inc. and its agents and affiliates a non-exclusive, royalty-free, irrevocable, perpetual, and full sublicensable right to reproduce, modify, combine, rewrite, adapt, change, translate, create derivative works from and display throughout the United States and the rest of the world in any media now know or invented in the future. You represent that you own or control all of the rights to any posted content, that the content is accurate, and that it does not violate the rights of any person or entity. Teachbits.com has the right, but no obligation, to monitor, edit, and remove any activity or content. Teachbits.com takes no responsibility and assumes no liability for any content posted by you or any other party.

PRIVACY
We use all means possible to keep any information you provide us safe. We will not provide information about you, either for sale or rent, to others without your consent.

LIMITATION OF LIABILITY AND DISCLAIMER OF WARRANTIES
We will not be liable for indirect, special, or consequential damages, or any loss of revenue, profits, or data, arising in connection with this Agreement, even if we have been advised of the possibility of such damages. In addition, we are not liable for any errors or omissions on our website.  Further, our aggregate liability arising with respect to this Agreement will not exceed the total costs paid by you for the purchase of selected items.

We make no express or implied warranties or representations with respect to the program or any products sold through the program, including, without limitation, warranties of fitness, merchantability, non-infringement, or any implied warranties arising out of a course of performance, dealing, or trade usage. In addition, we cannot guarantee that our websites will operate error-free or uninterrupted, and we will not be held liable for the consequences of any errors or interruptions.

INDEMNITY
You will indemnify and hold Teachbits.com, InfoSource, Inc., and its employees, officers, directors, agents, affiliates, divisions, subsidiaries, and joint ventures harmless from any claim or demand, including reasonable legal fees, made by any third party due to or stemming from your breach of this Agreement, or your violation of any law or the rights of any third party.

RELATIONSHIP BETWEEN YOU AND US
No agency, association, employee, franchise, partnership, or joint venture relationship exists between you and Teachbits.com and InfoSource, Inc., and none is intended or created by this Agreement.

NOTICES
Unless specified otherwise, you shall serve legal notices to us at the address(es) supplied in the Contact section of this Agreement.

APPLICABLE LAW
This Agreement will be interpreted according to the laws of the State of Florida, regardless of the place of its physical execution. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement.

INDEPENDENT INVESTIGATION
You acknowledge that you have read this agreement and agree to all of its terms and conditions. You have independently evaluated the desirability of participating in the program and are not relying on any representation, guarantee, or statement other than as set forth in this Agreement.

SITE POLICIES
We reserve the right to modify our site, policies, and these conditions of use at any time, for any reason, and without notice. Should any condition be deemed invalid or void, that condition shall be severed and shall not affect the overall validity and enforceability of any remaining condition(s).

DISPUTE RESOLUTION
Any dispute will be submitted to confidential arbitration in either Seminole County or Orange County, Florida, except that, in the case of intellectual property rights violation, Teachbits.com and InfoSource, Inc. may seek an injunction against you in any state or federal court within the State of Florida. All arbitration shall be conducted under the rules then prevailing at the American Arbitration Association, and any awards shall be binding.

ENTIRE UNDERSTANDING
This Agreement constitutes the entire understanding between us.
